By accessing or using this Website, or by placing an order with us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use this Website.

NZ Pipe is a 100% New Zealand owned and operated retailer of plumbing, drainage, spouting, gas plumbing, electrical, pneumatic, and hardware products, serving both trade professionals and DIY customers.

2. Use of This Website

You agree to use this Website only for lawful purposes. You must not:

  • Use the Website in any way that breaches any applicable New Zealand law or regulation

All prices displayed on the Website are in New Zealand Dollars (NZD) and are inclusive of GST unless otherwise stated.

We take reasonable care to ensure product descriptions, images, and pricing are accurate. However, errors may occasionally occur (for example, due to a technical fault or human error). If a product is listed at an incorrect price or with incorrect information, we reserve the right to:

  • Refuse or cancel the order, even if it has been confirmed or payment has been processed, and
  • Provide a full refund of any amount paid for the affected item

We will always notify you if this occurs.

Product availability is subject to change without notice. We reserve the right to discontinue any product at any time.

4. Orders and Payment

By placing an order, you are making an offer to purchase the product(s) in your cart. We reserve the right to accept or decline any order at our discretion (for example, in cases of suspected fraud or pricing errors).

Full payment is required at the time of ordering. We accept payment via credit/debit card and bank transfer/direct deposit, as outlined on our Orders & Payments page.

Orders will only be processed and dispatched once payment has been received and confirmed.

5. Shipping and Delivery

Shipping, delivery timeframes, courier partners, pickup options, and delivery restrictions are detailed on our Shipping & Returns page, which forms part of these Terms.

While we make every reasonable effort to meet estimated delivery timeframes, these are estimates only. We are not liable for delays caused by circumstances outside our reasonable control, including courier delays, extreme weather, or other events beyond our control.

6. Returns, Refunds, and Consumer Guarantees

Your rights under New Zealand law are not affected by these Terms.

Where you are purchasing as a consumer (i.e. for personal, domestic, or household use), your purchase is protected by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under these Acts.

Business-to-Business (B2B) Sales:
Where you are purchasing as a business, for business or trade purposes (rather than personal, domestic, or household use), you agree that the guarantees under the Consumer Guarantees Act 1993 do not apply to your purchase, to the extent permitted under section 43(2) of that Act. This agreement applies only where both you and NZ Pipe Limited are acting in trade, and you confirm this by proceeding with your purchase under a registered trade account or business capacity. This does not affect your rights under the Fair Trading Act 1986 or any other applicable law that cannot be excluded by agreement.

7. Product Warranties

Many products sold on this Website carry a manufacturer's warranty in addition to your rights under the Consumer Guarantees Act. Details of any specific manufacturer warranty will be provided on the relevant product page where applicable. Manufacturer warranty claims may need to be directed to the manufacturer directly, and we will assist where reasonably possible.

8. Limitation of Liability

To the maximum extent permitted by law, and subject to your rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986 (which cannot be excluded for consumer sales):

  • NZ Pipe Limited's total liability to you for any claim arising from your use of this Website or purchase of products shall not exceed the amount paid by you for the relevant product(s).
  • We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits, loss of use, or loss of data, arising from your use of this Website or our products, except where such liability cannot be lawfully excluded.

Nothing in this clause limits or excludes any liability that cannot be excluded under New Zealand law, including liability under the Consumer Guarantees Act 1993 for consumer purchases.

9. Intellectual Property

All content on this Website, including text, images, logos, graphics, and product descriptions, is owned by or licensed to NZ Pipe Limited and is protected by New Zealand and international copyright and trademark laws. You may not reproduce, distribute, or use any content from this Website for commercial purposes without our prior written consent.

10. Building Product Information

Where required under the Building (Building Product Information Requirements) Regulations 2022, applicable Building Product Information Sheets (BPIS) for designated building products are made available on our Building Product Information page. It is your responsibility to review this information to ensure a product is suitable for your intended use and complies with relevant Building Code requirements.

Your use of this Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Privacy Act 2020.

13. Governing Law and Disputes

These Terms are governed by the laws of New Zealand, and you submit to the exclusive jurisdiction of the courts of New Zealand.

If a dispute arises that cannot be resolved directly with us, consumers may have the right to file a claim with the Disputes Tribunal (for claims up to $60,000) or seek assistance from the Commerce Commission (0800 943 600) regarding Fair Trading Act matters.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
